@Vulpis: Fairuse was circumvented by DMCA. Someone makes a claim of copyright violate. Youtube has 2 options, be shut down or remove the video at once. Then uploader must win a lawsuit before the video is allowed back on, there is no penalty for false claims

This shows in what a shameful state copyright law is, when you can silence competition (and political competition) through its use. DMCA is crap.

@MisterPink: Do that, they give a bad name to French Canadians since people in Steam start saying they are French Canadian developers.

@T Watsky: Yep, their apology letter is pathetic and insincere. Those assholes not going to get a lot of money now.

@Bruceski: No, but TB did talk about it in the video. If you don't know: TB did a 3 hour podcast with another Youtuber and they talked about Pokemon X and Y. They where forced by Sega to not monetize the video because it contained 1 MINUTE of footage from the X and Y Trailer (1 min of 180)

Woah woah... hold on here! I thought the story was that the studio DIDN'T pull the video and that people were going too far to assume the video got pulled cause TB did an honest review.

Let's be honest here, a small low budget company can't possibly think removing the video will change the game.

@Tk: Yeah, looks to me as though he's trying to belittle Jo and TotalBiscuit. It's kind of funny because he says they're lying and twisted things, when there's not even a shred of ambiguity as to what has taken place with regard to Wild Games Studio's blatant copyright take-down abuse.

I live very near from Wild Games Studio, Mascouche, Québec, Canada.
I might go there and tell them in person.

Their office is in a poor rural area. Failure as programmers and game designers, they should go back to school. And they're uncapable of speaking decent english AND french. In CANADA.

I'm glad Jo did a comic about that, cause I saw TB's vid before it got removed, and as always, it's like 90% correct, his reviews are always great giving as good details about that certain game whether it's worth it or not.

@T Watsky people should spam youtube with reports forcing them to make reporting harder.

@Bike Man: Looks like English to me. Are you sure YOU'RE a native speaker?

US law requires removing offending content. It doesn't require immediately acquiescing to any and all demands regardless of whether or not the entity actually presents a case in good faith. Youtube could always delay removing the cited content until the user has an opportunity to counterclaim.

@Bruceski: TB did a review of Garry's Incident, in which he was very critical of the game. The game's creators didn't like this, so they had the video pulled.
Bike Man

I'd be nice if Jo could get a native English speaker to edit each comic's transcript. The text is still understandable, and for a non-native speaker it's a great job, but mistakes would be so easy to correct.

Is this the one where TB used footage directly from the official Pokemon XY trailer, it got caught by automatic filters and he tried to play it off as being targeted, or did something else happen?

@mrttao: Except that the US government rules say this material *is* allowed to be used for things like reviews under 'Fair Use'. If anything, YouTube is violating those same governmental rules by allowing the takedown system to be abused in such a manner.
it isn't youtube's rules, its the US government's rules that youtube must abide by.

Alright references popular culture to get hits (ironic) but do you have to keep spreading the same lie and hate. There was only one review that was removed and plenty of negative ones not, stop twisting everything fanatics to make it fit you're twisted little box to worship some critic.

This issue is the reason I no longer do let's plays. YouTube let every one of my accounts go down one by one because asshats kepts flagging me for just the dumbest shit. I even had a unique idea and was gonna monetize and be a partner, but I guess not :-/

In case anyone doesn't get MY butthurt, read the 'apology' carefully: You'll find the words 'fault' and 'error' describing themselves, but look at what it's for, and then bear in mind the root issue - The selective takedown, not 'not communicating'. For the rest, it's "sorry you feel hurt."
T Watsky
Unless it will. *Shrug* You can see in their thread that they have people encouraging the community to accept their 'apology'. Personally, I find no mea culpa apologies to be more insulting than refusing to apologize at all.

I love their 'apology'.

Summary: "We did nothing wrong, it's your fault. However, we're sorry you feel butthurt."

That's pretty standard corporate practice: Never admit fault... But clearly, that's not going to work now.

WarZ was what became Infestation. DayZ is still the Arma 2 mod and soon to be stand alone title.

TotalBiscuit did a good job spreading the word. A company that copyrights YouTube videos with negative commentary and bribes people with Steam keys to vote for them in Greenlight should be boycot.

Interesting topic. Although I have not heard of any reviewers -yet- giving any positive, aside from some redditor outing a few metacritic user reviews as being of employees due to copy-pasting the same review across multiple users.
